Agreement to Terms
By creating an account or using this platform, you agree to these Terms of Use. If you do not agree, do not use the platform. These terms govern your participation in the Poca Investment Club, an educational program of the Pocahontas Financial Education Foundation (the "Foundation").
1Educational Purpose
This platform is provided for educational purposes. Its goal is to help members in and around Marlinton, West Virginia learn about investing, financial literacy, and nonprofit governance through simulated portfolios, research, discussion, voting, and lessons.
2Membership & Account Requirements
You must provide accurate information to create and maintain an account. Membership classes (Student Member, Adult Member, Adult Active Member) and roles carry different privileges and responsibilities as defined in the Foundation's Bylaws. Members under 18 require verified parental or guardian consent before full access is granted. You are responsible for keeping your credentials secure and for activity under your account.
3Acceptable Use
You agree to use the platform lawfully and respectfully. You will not misuse accounts, attempt to circumvent access controls, submit false records, harass others, or use the platform for unauthorized commercial purposes. Violations may result in suspension or termination under Section 11.
4Investment Simulations
Simulated portfolios use hypothetical capital for learning. Simulated performance does not represent real money, real holdings, or real returns. Simulation results are educational and may differ materially from real-world outcomes.
5Real Market Data
Market data shown on the platform is provided by third-party data services and may be delayed, incomplete, or inaccurate. We do not guarantee the accuracy, timeliness, or completeness of any market data.
6No Investment, Tax, or Legal Advice
Nothing on this platform constitutes investment, financial, tax, or legal advice. Content is educational. You should consult a qualified professional before making financial decisions and should not rely on this platform for personalized advice.
7No Guarantee of Investment Results
The Foundation and Poca make no guarantee regarding any investment outcome. Investing involves risk, including the loss of principal. Past or simulated performance does not predict future results.
8Member Research & Voting Is Educational
Member research, investment ideas, and votes are part of the educational process. They reflect members' learning and opinions and do not constitute professional recommendations. Voting outcomes inform Foundation decisions but are educational exercises.
9Real Charitable Assets Controlled by Foundation Governance
Any real charitable assets (including real-money portfolios and donations) remain under the control of the Foundation and its governance structure. Decisions about real assets are made through the Foundation's governance processes (board approvals, officer authority, and recorded resolutions), not by individual members. Member votes on real assets are advisory or recommendatory as defined in the Foundation's policies.
10Intellectual Property
The Foundation owns the platform and its educational content. Member-submitted content remains the member's, but you grant the Foundation a non-exclusive license to use it within the platform for educational and governance purposes. You must respect others' intellectual property when contributing.
11Account Suspension & Termination
The Foundation may suspend or terminate accounts that violate these terms, its policies, or applicable law, or that compromise the platform. Where appropriate, the Foundation will provide notice and an opportunity to respond consistent with its governance.
12Third-Party Services & Data
The platform uses third-party services for authentication, hosting, market data, email, and payments. The Foundation is not responsible for the acts or omissions of these third parties beyond its control.
13Disclaimers & Limitation of Liability
The platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, the Foundation and its officers, directors, and members are not liable for any indirect, incidental, or consequential damages arising from your use of the platform or reliance on its content.
14Governing Law
These terms are governed by the laws of the State of West Virginia, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in Pocahontas County, West Virginia, or as otherwise required by law.
15Changes to Terms
The Foundation may update these Terms. Material changes will be versioned, recorded in the governance record book, and require you to re-accept the updated version when you next sign in. Prior versions are preserved. Continued use after changes constitutes acceptance where re-acceptance is not prompted.
